index file gets ignored

Even though example.com has the following:

index index.php index.html;

accessing a folder that has an index.html file gives a drupal 404. adding the index.html to the path works.

Basically something like http://servername/misc/ads/ gives a drupal 404, while http://servername/misc/ads/index.html works.
