<def />”ותיק מלחמה“ – מי שהוא אזרח ישראלי ותושב ישראל והתקיים בו אחד מאלה:</p>

<p>הוא שירת בתקופה שבין י"ז באלול התרצ"ט (1 בספטמבר 1939) לבין כ"ד באלול התש"ה (2 בספטמבר 1945), בשירות פעיל בצבא אחת ממעצמות הברית או באחת היחידות שלחמו במחתרת נגד שלטון עוין, למעט שירות צבאי אשר חל עליו <ref href="/akn/il/act/PrimaryLegislation/1959-09-23/2002247">חוק הנכים (תגמולים ושיקום), התשי"ט–1959 [נוסח משולב]</ref>;</p>

<p>הוא הוכר על ידי שלטונות ברית המועצות לשעבר בתעודה רשמית או באות רשמי כמגן העיר לנינגרד או כתושב העיר בעת המצור עליה בתקופת מלחמת העולם השניה;</p>

<def />”ותיק מלחמה נזקק“ – ותיק מלחמה הזכאי לגמלה לפי <ref href="/akn/il/act/PrimaryLegislation/1980-12-01/147335">חוק הבטחת הכנסה, התשמ"א–1980</ref>;</p>

<p>
<def />”מחוסר דיור“ – מי שאין ולא היתה בבעלותו או בבעלות בן זוגו דירה או חלק בדירה והוא אינו מתגורר בדיור ציבורי;</p>

<point eId="point_1__point_מעצמות_הברית">
<content>
<p>
<def />”מעצמות הברית“ – המדינות שחתמו על הצהרת האומות המאוחדות ביום ב׳ בטבת התש"ב (1 בינואר 1942) או שהצטרפו אליה בתקופת מלחמת העולם השניה, וכן שאר המדינות אשר לחמו באותה תקופה נגד גרמניה ובני בריתה, שעה שלחמו נגדן;</p>

<num>(א)</num>
<content>
<p>הגיש אדם בקשה להכרה כוותיק מלחמה והתקיימו בו התנאים שבהגדרה ותיק מלחמה <ref href="#point_1">שבסעיף 1</ref>, תכיר בו ועדת הציון כוותיק מלחמה ותעניק לו אות־זיכרון בצירוף תעודה.</p>

<num>(ב)</num>
<content>
<p>הוראות <ref href="/akn/il/act/SecondaryLegislation/1968-12-19/100002967#point_22">סעיפים 22 עד 25 לתקנון יד ושם</ref> יחולו על ועדת הציון כשהיא פועלת לפי הוראות חוק זה, בשינויים המחויבים.</p>

<num>(ג)</num>
<content>
<p>הרואה את עצמו נפגע מהחלטת ועדת הציון רשאי לערור עליה לפני ועדת הערעורים כמשמעותה <ref href="/akn/il/act/SecondaryLegislation/1968-12-19/100002967#point_26">בסעיף 26 לתקנון יד ושם</ref>.</p>

<p>דיור ציבורי</p>

<p>ותיק מלחמה נזקק הזכאי ממשרד הבינוי והשיכון לסיוע בתשלום שכר דירה, זכאי לתוספת בשיעור של 10% מסכום הסיוע שהוא זכאי לו.</p>

<num>(ב)</num>
<content>
<p>שר העלייה והקליטה ושר הבינוי והשיכון, בהסכמת שר האוצר, יקבעו הוראות בדבר מתן עדיפות לדיור בהשכרה ציבורית לוותיקי מלחמה נזקקים מחוסרי דיור.</p>

<p>ותיק מלחמה נזקק זכאי להנחה בעד תרופות הכלולות בסל שירותי הבריאות כאמור <ref href="/akn/il/act/PrimaryLegislation/1994-06-26/157723#point_8">בסעיף 8(ז)(4) לחוק ביטוח בריאות ממלכתי, התשנ"ד–1994</ref>.</p>

<p>ותיק מלחמה נזקק זכאי אחת לשנה למענק הטבות בסכום השווה ל־35% מהשכר הממוצע המחושב לפי <ref href="/akn/il/act/PrimaryLegislation/1995-05-15/158093#point_2">סעיף 2 לחוק הביטוח הלאומי [נוסח משולב], התשנ"ה–1995</ref>, ואולם ותיק מלחמה נזקק הזכאי למענק הטבות לפי <ref href="/akn/il/act/PrimaryLegislation/1992-04-09/174461">חוק תגמולים לאסירי ציון ולבני משפחותיהם, התשנ"ב–1992</ref>, זכאי למענק הטבות אחד בלבד בשיעור הגבוה מביניהם.</p>

<num>(ב)</num>
<content>
<p>משרד העלייה והקליטה ישלם את המענק לוותיק מלחמה נזקק הזכאי למענק הטבות לפי סעיף זה, בכל שנה, לא יאוחר מ־9 במאי, ובתחילת חודש אוגוסט, בחלקים שווים.</p>

<p>אלמן ואלמנה של ותיק מלחמה נזקק</p>

<num>7.</num>
<content>
<p>נפטר ותיק מלחמה נזקק ותכוף לפני פטירתו קיבל מענק הטבות לפי <ref href="#point_6">סעיף 6</ref>, יהיו האלמן או האלמנה בשעת פטירתו, זכאים לקבל את מענק ההטבות לפי <ref href="#point_6">הסעיף האמור</ref> למשך תקופה של 3 שנים מיום פטירתו.</p>

<p>מניעת כפל הטבות</p>

<p>ותיק מלחמה נזקק הזכאי להטבה לפי חוק זה, ובאותו ענין שבתחומי ההטבה זכאי להטבה גם לפי כל דין אחר, זכאי להטבה אחת בלבד בשיעור הגבוה מביניהן.</p>

<p>ותיק מלחמה שועדת הציון הכירה בו כוותיק מלחמה לפני יום כ"ז באייר התש"ס (1 ביוני 2000) (להלן – יום התחילה), זכאי להטבה החל ביום התחילה או לאחריו, אם ביום התחילה או לאחריו הוא ותיק מלחמה נזקק הזכאי להטבה.</p>

<num>(ב)</num>
<content>
<p>אדם שהגיש לועדת הציון בקשה להכרה ביום התחילה או לאחריו, וועדת הציון הכירה בו כוותיק מלחמה, זכאי להטבה החל ביום שהוא הגיש לועדת הציון את הבקשה להכרה או לאחריו, אם ביום הגשת הבקשה או לאחריו הוא ותיק מלחמה נזקק הזכאי להטבה.</p>

<p>ותיק מלחמה נזקק זכאי להטבה לפי חוק זה כל עוד הוא ותיק מלחמה נזקק הזכאי לאותה הטבה.</p>

<p>לא תשולם ולא תינתן הטבה לפי חוק זה בעד תקופה שקדמה ליום התחילה.</p>
