Moreover, by … [four years from the date of entry into force of this Regulation] and every four years thereafter, the Commission should evaluate and report to the European Parliament and to the Council on the need to amend the list of high-risk areas headings in the annex to this Regulation, the AI systems within the scope of the transparency obligations, the effectiveness of the supervision and governance system and the progress on the development of standardisation deliverables on energy efficient development of general-purpose AI models, including the need for further measures or actions.

so every 4 years we have to report on the energy efficiency of our AI models?

and we need to incorporate into a code of conduct?

  1. A detailed description of the elements of the model referred to in point 1, and relevant information of the process for the development, including the following elements:

(e) known or estimated energy consumption of the model. With regard to point (e), where the energy consumption of the model is unknown, the energy consumption may be based on information about computational resources used.

I was curious, so I've had a look into this in a bit more detail, while I'm not a lawyer, and while I'm not sure if's directly relevant to the Realtime Carbon Dataset in its current form, I think you can make an argument that the EU AI act does require a level of disclosure around energy usage that would be made much easier by having this information in the dataset being created here.

There's some discussion in this LinkedIn post here, but for convenience, I also put together a google doc pointing to the specific parts of the law that might be drivers for reporting energy usage.. I've attached a PDF snapshot of the Google doc for people are not able to use Google apps.

As an aside, I didn't see any mention of carbon intensity for energy being reported here, and the act seems to focus on energy usage, not carbon emissions resulting from the energy use.
