2121 Thank you for the additional information. Just to confirm my understanding, you’re saying if a customer has no access to Internet Banking to access any of their accounts then they are still eligible CDR consumers ? In this case, it’s not the individual accounts that are blocked, it’s the customer’s access to internet banking.
I believe rules 3.5 and 4.7 relates to blocked or suspended accounts, not suspended/blocked Internet Banking. There’s a big difference here. When Internet Banking is blocked and the customer cannot login, this means they cannot access their consumer dashboard or DOMS which is usually located within Internet Banking.
Thanks for your follow up question and apologies for any confusion. We agree that a temporary inability to access online banking does not necessarily mean a specific account has been blocked or suspended. However, our view regarding the impact on consumer eligibility remains the same. That is, a consumer remains eligible where their online access to an account is temporarily disabled. This is because, at this time, the account is still set up, or designed, to be accessible online, as is required by clause 2.1(1) of Schedule 3 to the rules.
2124 I represent an Australian organisation that provides Margin Lending/Portfolio Lending products to customers and I'm looking for some clarification as to whether these product types are in scope for the Non Bank Lending phase of CDR. As you have indicated, a loan for an investment is currently a phase 3 product and considered an in-scope product for CDR in the banking sector (see clause 1.4 of Schedule 3 to the CDR Rules).
Treasury has just completed consultation on the exposure draft rules to expand CDR to the non-bank lending sector. The exposure draft rules propose to include loans for an investment as covered products in both the banking and non-bank lending sectors. Hence, products relating to loans for an investment may be considered in-scope products for the non-bank lending sector and be subject to data sharing obligations for affected non-bank lenders if the relevant requirements in the CDR Rules are met. Note these rules have not yet been made.
Please refer to Treasury’s website for further information on the expansion of CDR to the non-bank lending sector.
2127 We are hoping you can point us to the location of the documentation relating to specific obligations and penalties for our BAU teams to log. You and your team can find details about CDR specific obligations and penalties within Part IVD of the Competition and Consumer Act 2010, the CDR Rules, and the Consumer Data Standards.
The Quick Reference Guide to finding key documents in the CDR legislative framework may also assist in locating other instruments that should be read in conjunction with the above including sector designation instruments and relevant CDR regulations.
We note that CDR participants are responsible for ensuring their own compliance with CDR obligations and recommend CDR participants seek independent advice on how best to achieve compliance in their specific circumstances. However, we hope that the above information assists you.
